Case: Supreme Court judgment of 26 January 2009: Compensation and damages at the amount of 13,500 euro for infringement of a trademark

The ruling was made public (in Danish) in Ugeskrift for Retsvæsen 2009 page 1018.


A Nordic chain of retail stores admitted to have infringed a well known trademark by import and sale from the stores. The case concerned approximately 17,000 wallets, sold at 2.70 euro apiece. It was unchallenged that the infringement was negligent. The payment of damages and compensation was calculated based on the turnover of the chain store from the wallets (consisting of approximately 45,000 Euro) and on the disturbance of the market.
